Archimedes Worldwide, LLC (“Archimedes Worldwide,” “Archimedes,” “we,” “us,” or “our”) respects the privacy of individuals who visit our websites, communicate with us, use our services, or interact with businesses that use our technology and services.

This Privacy Policy describes how Archimedes Worldwide collects, uses, processes, stores, and discloses personal information in connection with our websites, technology platforms, business services, and related products and programs, including Archimedes BOS™.

Archimedes BOS is a technology-enabled business platform through which Archimedes Worldwide may provide or facilitate advertising, marketing, business consulting, customer relationship management, communications, automation, artificial intelligence, scheduling, reputation management, business optimization, and related services.

This Privacy Policy applies to ArchimedesWorldwide.com, Archimedes BOS, and other websites, applications, forms, communications, and services that link to or reference this Privacy Policy.

1. Information We Collect

Depending upon how you interact with Archimedes or one of our business customers, we may collect information including:

Contact Information. Name, business name, mailing address, email address, telephone number, job title, and similar contact information.

Account Information. Login information, account identifiers, preferences, user permissions, and information associated with an Archimedes BOS account.

Business Information. Information regarding a business, its operations, employees, customers, prospects, sales processes, marketing activities, appointments, transactions, communications, and business performance.

Communications. Emails, text messages, telephone calls, chat conversations, web-form submissions, support requests, appointment requests, and other communications.

Customer and Prospect Information. Businesses using Archimedes BOS may enter or collect information concerning their customers and prospective customers. This may include names, telephone numbers, email addresses, addresses, appointment information, service requests, estimates, sales opportunities, communications, and other information relevant to the business relationship.

Payment and Transaction Information. When payments are made through services connected with Archimedes, payment information may be processed by third-party payment processors. Archimedes may receive transaction information such as payment status, amount, date, customer, subscription, or invoice information. We generally do not directly store complete payment-card numbers when payment processing is performed by a third-party processor.

Technical Information. Internet Protocol address, browser type, device information, operating system, referring pages, pages visited, timestamps, cookies, and similar technical or usage information.

AI and Automation Information. Information submitted to or generated through AI-assisted features, including conversations, call transcripts, summaries, classifications, extracted information, prompts, automated responses, and workflow activity.

2. How We Collect Information

We may collect information directly from you, from our business customers, through websites and forms, through Archimedes BOS, through telephone, SMS, email, chat or AI-assisted communications, and through third-party services and integrations authorized by us or our customers.

We may also automatically collect certain technical information when websites or technology services are accessed.

3. How We Use Information

Archimedes may use information to:

• provide, operate, maintain, configure, and improve our services;

• provide Archimedes BOS platform functionality;

• perform advertising and marketing services;

• provide business and marketing consulting;

• implement CRM systems, workflows, automations, and business processes;

• capture, organize, route, and follow up with leads;

• schedule and manage appointments;

• facilitate customer communications;

• provide AI-assisted receptionist, customer-service, sales, marketing, and administrative functionality;

• send authorized email, SMS, telephone, or other communications;

• manage subscriptions, accounts, billing, and customer service;

• analyze business and marketing performance;

• improve products, services, workflows, and customer experiences;

• prevent fraud, abuse, security incidents, or unlawful activity;

4. Archimedes BOS Business Customer Data

An important distinction exists between information Archimedes collects for its own business purposes and information processed through Archimedes BOS on behalf of our business customers.

A business using Archimedes BOS may use the platform to manage information concerning its own customers, prospects, employees, vendors, and other contacts.

In those circumstances, the business customer generally determines why the information is collected, how it will be used, and which communications will be sent. Archimedes processes that information as necessary to provide the contracted technology-enabled services.

Business customers are responsible for obtaining any notices, permissions, consents, or authorizations required by applicable law for information they collect and for communications they initiate or authorize through the platform.

Individuals with questions about information collected by a particular Archimedes business customer should generally contact that business directly.

5. Artificial Intelligence and Automated Systems

Archimedes BOS may incorporate artificial intelligence, machine learning, automated workflows, conversational agents, voice agents, and other automated technologies.

These systems may process information supplied by users, customers, prospects, or third-party services to perform tasks such as answering inquiries, scheduling appointments, summarizing conversations, classifying leads, assisting with marketing, routing information, generating content, or automating business processes.

AI-generated information may be inaccurate or incomplete. Businesses using Archimedes BOS remain responsible for appropriate human supervision of automated systems and for determining whether generated information or automated actions are appropriate for their particular circumstances.

Information should not be submitted to AI-enabled features unless the user or business has the right and authority to provide and process that information.

6. Email and SMS Communications

Archimedes and businesses using Archimedes BOS may communicate through email, SMS/text messaging, telephone, or other communication channels when permitted by applicable law and the recipient's consent or other applicable legal basis.

Message frequency may vary.

Message and data rates may apply.

Consent to receive marketing text messages is not a condition of purchasing goods or services unless expressly permitted by applicable law.

Recipients may generally opt out of marketing text messages by replying STOP and may request assistance by replying HELP.

Businesses using Archimedes BOS are responsible for ensuring that their communication campaigns comply with applicable consent, registration, identification, recordkeeping, and opt-out requirements.

7. Cookies and Similar Technologies

Our websites and technology services may use cookies, pixels, tags, local storage, and similar technologies to operate services, remember preferences, understand usage, measure marketing effectiveness, improve functionality, and maintain security.

Users may be able to control certain cookies through browser settings or other privacy controls. Disabling certain technologies may affect website or service functionality.

8. How We Disclose Information

We may disclose information when reasonably necessary to provide our services, including to technology providers, hosting providers, telecommunications providers, payment processors, email and SMS providers, analytics providers, professional advisers, contractors, and other service providers assisting our operations.

We may also disclose information:

• at the direction of a business customer;

• to provide an integration requested or authorized by a customer;

• when required by law, subpoena, court order, or lawful governmental request;

• to investigate fraud, abuse, security incidents, or violations of our agreements;

• to protect the rights, property, safety, or security of Archimedes, our customers, users, or others; or

• in connection with a merger, acquisition, financing, restructuring, sale of assets, or similar business transaction.

We do not sell personal information simply for monetary payment as part of our ordinary business model.

9. Third-Party Platforms and Integrations

Archimedes BOS incorporates and may connect with technology and services supplied by third parties.

These may include hosting, telecommunications, email, SMS, payment processing, artificial intelligence, calendars, social networks, advertising platforms, accounting systems, business applications, and other technology providers.

Use of third-party services may also be governed by the privacy policies and terms of those providers.

Archimedes does not control the independent privacy practices of third-party providers.

10. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect information against unauthorized access, loss, misuse, alteration, or disclosure.

No Internet transmission, telecommunications system, cloud service, or electronic storage system can be guaranteed to be completely secure. Accordingly, we cannot guarantee absolute security.

Users are responsible for maintaining the confidentiality of their account credentials and for promptly notifying Archimedes of suspected unauthorized account access.

11. Data Retention

We may retain personal information for as long as reasonably necessary to provide services, maintain business and financial records, fulfill contractual obligations, resolve disputes, enforce agreements, meet legal or regulatory requirements, protect against fraud or abuse, and support legitimate business operations.

Information processed on behalf of an Archimedes BOS business customer may also be retained according to that customer's configuration, instructions, contractual arrangements, and applicable law.

12. Privacy Rights

Depending upon where an individual resides, applicable law may provide rights concerning personal information, which may include rights to request access, correction, deletion, portability, or information concerning certain disclosures or uses.

Not all rights apply in all circumstances, and certain information may be exempt from a request where permitted by law.

Archimedes may take reasonable steps to verify the identity and authority of a person submitting a privacy request.

Where Archimedes processes information on behalf of a business customer, we may direct the individual to the applicable business customer or assist that customer in responding to the request.

13. Children's Privacy

Archimedes Worldwide and Archimedes BOS are designed primarily for businesses and adults.

Our services are not directed to children under 13, and we do not knowingly collect personal information directly from children under 13 for our own marketing purposes.

If we learn that personal information from a child has been collected in circumstances prohibited by applicable law, we will take appropriate steps to address the information.

14. Telephone Calls and Recordings

Telephone calls handled through Archimedes BOS may use automated systems, artificial intelligence, transcription, monitoring, or recording functionality.

Businesses using these capabilities are responsible for configuring and operating them in accordance with applicable federal and state laws, including any notice or consent requirements applicable to call recording or automated communications.

Where required, callers should be informed that a call may be recorded, transcribed, monitored, or handled with automated technology.

15. Business Transfers

If Archimedes Worldwide or a material portion of its business or assets is acquired, reorganized, merged, financed, or transferred, information may be transferred as part of that transaction subject to applicable law.

16. International and Interstate Processing

Archimedes Worldwide operates from Puerto Rico and provides services to businesses and individuals in other jurisdictions.

Information may therefore be processed or stored in Puerto Rico, the United States, or other locations where Archimedes or its service providers operate.

By using our services, information may be transferred and processed outside the jurisdiction in which it was originally collected, subject to applicable legal requirements.

17. Financial, Legal, Tax, Medical and Other Regulated Information

Unless a particular service expressly provides otherwise, Archimedes BOS and its AI or automation features should not be relied upon as a substitute for advice from qualified legal, tax, medical, financial, accounting, insurance, or other licensed professionals.

Business customers should not configure Archimedes BOS to collect or process specially regulated or sensitive information unless they have determined that the proposed use is lawful and appropriate and that required safeguards and agreements are in place.

18. Changes to This Privacy Policy

We may update this Privacy Policy periodically to reflect changes in our services, technology, business practices, or legal requirements.

The current version will be identified by the “Last Updated” date appearing above. Material changes may be communicated through our website, platform, email, or another reasonable method when appropriate.
